Legal Definitions and Organizations

1Marijuana Enforcement Division (MED)
Oversees dispensaries, optional premises (OPC, aka our garden), and medically infused product kitchens (MIPS). Used to be the Medical Marijuana Enforcement Division (MMED).
2Colorado Department of Public Health & Environment (CDPHE)
Oversees licensing to patients and is in charge of educating dispensaries about rules and regulation charges.
3Medical Card
The state-issued license given to patients allowing them to shop at MMJ care centers. Dispensaries are required to keep an updated list of their patients on site.

General Rules & Regulations

1Dispensary Privileges & Restrictions
  • Employees must wear badge while on premises
  • Patients must bring all required documents to shop (No Excuses)
  • Dispensary must keep all medical patient paperwork on file in their system.
  • MMJ may only be sold between 8 am and 10 pm:
    • We can only sell to temporary paperwork patients Monday - Friday 10am - 5pm
    • We cannot sell to temporary paperwork patients on holidays (CDPHE is closed)
    • We cannot sell anything medically to non-patients (recreational users), even if it is non-medicated
  • Non-patients may only wait in designated waiting areas in each center:
    • Only caregivers and necessary assistants are allowed back with the patient. If a patient needs someone to help them see, remember what works for them etc.
    • Anyone allowed in back with patient should have ID scanned into patient's profile.
  • No pets are allowed inside dispensary unless assisted needs animals
  • Recreational Customers need to have Valid ID to enter the Recreational Area, they may not be on the Medical Side.
2Medical Marijuana vs. Recreational Marijuana
  • Medical marijuana requires a doctor's recommendation, state fee, Colorado residency and approval from the state via Medical Card
    • Required to adhere to HIPAA compliance measures
    • Patients must have all documents on their person when purchasing or holding medical marijuana by law
    • We cannot sell anything medically to non-patients (recreational users), even if it is non-medicated
  • Recreational marijuana requires customers to be 21 years or older
3Illegal Activity
  • A patient may only buy products for themselves and no one else. Any indication of purchasing for others is grounds for us to terminate the sale with no questions asked.
  • A patient who receives money from another party on premises will be asked to leave immediately

Product Limit Rules & Regulations

1Medical Product Limits & Rules
  • We may only sell up to 56 grams of product per patient per day
  • This is regardless of patient's plant count (see Amendment added October 14, 2013)
  • This includes both locations (cannot get 56 grams from each location in one day)
  • Edibles are weighed in mg's (milligrams) and one edible = 1 gram for our compliance
2Recreational Product Limits & Rules
  • In-state Customers can purchase up to 28 grams - limit one visit per day
  • Out-of-State Customers can purchase up to 28 grams - limit one visit per day
  • 100 mg of edibles is equivalent to 3.5 grams of Cannabis.
  • 1 gram of concentrates is equivalent to 3.5 grams of Cannabis.
  • All consumable products must be locked in safe after hours
  • All flower must be handled with gloves (NO TOUCHING)
  • All flower, pre-rolls, and hash cartridges MUST be labeled before sale is complete!
3Company Restrictions
  • Staff may not ring up friends, significant others or family members
  • NO ON-SITE CONSUMPTION EVER
  • No call, No Show, No Job

Exit Packaging Rules & Regulations

1Medical Exit Packaging
All products leaving The Health Center must be in a state approved child resistant packaging. See store manager for details.
2Recreational Exit Packaging
All products leaving The Health Center must be in a state approved exit bag. See store manager for details.
3Exit Bags
Exit bags are child resistant and they are also considered a closed container when out of the drivers reach in a vehicle. THC CHarges 56 cents after tax for an exit bag. All product must be transported in a child resistant container, and some products will require a child resistant exit bag for this.
4Receipts
By Law every customer must be given a copy of their receipt.
